These Terms of Service ("Terms") govern your use of Estate Divvy, provided by Estate Divvy LLC ("Estate Divvy," "we," "us," or "our"). By creating an account, accepting an invitation, or using the service, you agree to these Terms.
1. What Estate Divvy Does
Estate Divvy provides software that helps families inventory personal property, invite participants, privately score preferences, and receive a proposed division of items. Estate Divvy is a decision-support tool, not a legal, probate, tax, appraisal, fiduciary, mediation, or estate-planning service.
2. Eligibility
You must be at least 18 years old to use Estate Divvy. You are responsible for ensuring that your use of Estate Divvy complies with applicable laws and any estate documents, court orders, executor instructions, trustee duties, or family agreements.
3. Accounts
You agree to provide accurate account information and keep your login credentials secure. You are responsible for activity under your account.
4. Estate Owners and Participants
The person who creates an estate is the estate owner for that workspace. Estate owners may have additional permissions, such as editing estate details, inviting participants, locking or unlocking the inventory, managing payment, and contacting support about the estate.
Invited participants may view estate information, add items where allowed, and submit their own private scores.
5. User Content
Users may upload item names, descriptions, photos, estimated values, room labels, notes, and other content. You retain ownership of your content, but grant Estate Divvy permission to host, process, display, and use it as needed to provide the service.
You agree not to upload unlawful, invasive, defamatory, infringing, or harmful content.
6. Scoring and Results
Participants submit private scores for items. Once final results are calculated, the estate may become locked or finished. Estate Divvy provides a proposed distribution based on submitted information and the algorithm used by the service.
Estate Divvy does not guarantee that all participants will agree with the result, that the result satisfies legal requirements, or that the result resolves all disputes.
7. Estimated Values
Estimated values are optional context unless otherwise stated in the product. Estate Divvy does not provide appraisals and does not guarantee the accuracy of any estimated value entered by users.
8. Payments and Refunds
Payment may be required to access final results for estates above the free limit. Payments are processed by Stripe.
Estate Divvy offers a money-back guarantee: if the estate is not satisfied with paid final results, the estate owner may request a refund within 14 days of payment by contacting support@estatedivvy.com. Estate Divvy may require enough information to identify the account and payment. See the Refund Policy for terms and timing.
9. Not Legal Advice
Estate Divvy does not provide legal advice. You should consult a qualified attorney, executor, trustee, mediator, tax advisor, appraiser, or other professional as needed.
10. Prohibited Uses
You may not use Estate Divvy to violate laws or third-party rights; harass, threaten, or impersonate others; upload malicious code or interfere with the service; attempt to access accounts, estates, or data without authorization; reverse engineer, scrape, or misuse the service; or use the service for fraudulent or abusive purposes.
11. Service Availability
We aim to keep Estate Divvy reliable, but the service may be unavailable from time to time due to maintenance, outages, provider issues, or other causes.
12. Third-Party Services
Estate Divvy relies on third-party providers for hosting, authentication, storage, payments, email, analytics, and background computation. We are not responsible for third-party services outside our control.
13. Termination
We may suspend or terminate access if you violate these Terms, create risk for Estate Divvy or other users, or use the service unlawfully. You may stop using Estate Divvy at any time.
14. Disclaimer
Estate Divvy is provided "as is" and "as available." We disclaim warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
15. Limitation of Liability
To the fullest extent permitted by law, Estate Divvy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, family disputes, legal disputes, or estate administration outcomes.
To the fullest extent permitted by law, Estate Divvy's total liability for any claim will not exceed the amount paid by you to Estate Divvy for the estate giving rise to the claim.
16. Governing Law
These Terms are governed by the laws of the state where Estate Divvy LLC is organized, without regard to conflict-of-law rules.
17. Changes
We may update these Terms from time to time. If changes are material, we will provide notice through the website, email, or another appropriate method.
